Deloitte Legal successfully defends an Irish insurance company before Constitutional Court

Deloitte Legal successfully defended an Irish insurance company before the Constitutional Court in an important case regarding the statute of limitations in insurance law and the nature of the branch 23 insurance life products.

In its decision of 22 October 2020, the Constitutional Court confirmed that a branch 23 life insurance product is not a financial product and there is no need to align the legal regime of these two products.

The Court also stated that the short statute of limitations of 3 years applicable to insurance products (including branch 23 life insurance products) is compatible with Articles 10 and 11 of the Belgian Constitution.
