Greenille Private Client team quoted in De Tijd on the separation of legal cohabitants

Patrizia Macaluso and Stefanie Denorme offer their views

Patrizia Macaluso and Stefanie DenormeConflict Handling specialists from Deloitte Legal's Greenille Private Client team, were quoted by De Tijd in an article that looks at the legal treatment differences between marriage and legal cohabitation in terms of separation.

In the article, Patrizia and Stefanie highlight the differences in how legal cohabitants proceed with separation and dispute resolution in comparison with the divorce process. While there are legal processes for legal cohabitants to resolve disputes, Patrizia and Stefanie underline that they are not subject to the same legal obligations as married couples, especially in claiming alimony to cope after the separation.

This difference is best summarised by Patrizia's statement that "If a legal cohabitant ends up in a custody battle, the position of the economically weaker one is much less legally anchored than in a marriage".
