De Opleiding Notariaat en de vakgroep Privaat en Economisch Recht van de Vrije Universiteit Brussel (VUB) organiseren sinds 2019 de Actualia Notariaat: een reeks praktijkgerichte vormingssessies die inspelen op de noden van het notariaat, de gespecialiseerde advocatuur en de vermogensplanningssector.

Deze editie focust op actuele thema’s uit het werkveld. Aan de hand van casussen en specifieke knelpunten bieden de sessies een heldere update en praktische inzichten. Het programma omvat zes topics (van elk 40 minuten): 1. inbreng en inkorting van giften, 2. erf- en schenkbelasting, 3. akten en attesten van erfopvolging, 4. internationaal privaatrecht, 5. beslag en rangregeling, en 6. ruimtelijke ordening (verkaveling).

Erfbelasting op verkrijgingen tussen echtgenoten bij overlijden kan onrechtvaardig lijken. Echtgenoten onder scheiding van goederen kunnen elkaar beschermen zonder fiscale nadelen via technieken zoals het verrekenbeding en sinds 2017 met verblijvings- en toekenningsbedingen, ondersteund door rechtsleer en rulings. Echtgenoten onder het wettelijk stelsel hebben minder opties, omdat erfbelasting wordt geheven over meer dan de helft van wat de langstlevende volgens het beding in de huwelijksovereenkomst verkrijgt. Zij kunnen echter de langstlevende beschermen door gemeenschapsgoederen horizontaal te schenken, vooraf goederen uit te brengen, te schakelen naar een scheidingsstelsel, gevolgd door schenking of bedingen in de huwelijksovereenkomst.
