Foreign subsidies regulation (FSR)

The FSR is designed to ensure fair competition by addressing distortions caused by foreign subsidies which may negatively impact the EU internal market. Our EU & Competition team advises both public and private entities with the notification of transactions involving financial contributions from non-EU governments. We also support governments and businesses during investigations conducted by the European Commission on its own initiative.

Why clients choose us

In close collaboration with our Deloitte (tax) consultants, our EU & Competition attorneys provide a comprehensive suite of solutions, including:

Analysis of notification requirements – We evaluate whether your intended transaction requires FSR notification to the European Commission, covering corporate transactions, investments, and bids in public procurement procedures involving financial contributions by non-EU governments.

Preparation of FSR notifications – Our EU & Competition team handles the preparation of FSR notification forms and related documentation in interaction with the European Commission.

Post-clearance follow-up – We provide tailored support to clients in the post-clearance application if required (for instance, in the application of remedies and commitments).
